Presentation

The Law of Obligations is the heart of the patrimonial Civil Law.

Among other important devices, the Contracts and the Civil Reponsibility (tort law) belong to the program. Economic collaboration and the defence of the citizen riights appear as central matters.

What justifies the collocation at the third scholarly year.

PART I - BASIC NOTIONS

Introduction

Cap. I  Concept, elements and function of the obligation, natural obligations, comparing with property rights.

Cap. II Principles and tendencies. Private Autonomy and good faith, protection of the weaker. Interdisciplinarity and internationalization.

 

PARTE II - SOURCES

 

Chap. I Contracts;

Chap. II Unilateral legal transactions;

Chap. III Negotiorum gestio;

Chap. IV Unjust enrichment;

Chap. V Torts;

Chap. VI Obligational relationships without primary instalment duties.

Objectives

Since we are dealing with a field heavily marked by the social dynamics, in this first semester we try to provide the students with theoretical frameworks that may allow them to understand and, at least in a certain way, to anticipate this evolution. This is why along with a relatively large chapter on «Fundamental Concepts» much stress is laid on the chapter on the «Sources of the Obligations».

Besides the legal rules, it's important that the students may know the principles and the development tendencies. This makes it necessary to develop the capacity of working with interdisciplinary elements.

Teaching methodologies and assessment

Students are allowed to intervene during the lectures. Discussion classes are designed both to ensure their questions get answered and to the analyse of specific cases.

Continual Evaluation.

May access the second test the students with a minimal of eight points on the first. If the final classification is 8 or 9 points, they must attend to an oral test or opt for an recourse examination. The recourse examination is composed by a written test, being compulsory the oral test for those studentes marked with 8 or 9 points.

Good, intensive class participation and written reports is also an evaluation element, until 20%.
